About This Briefing:

Codes of Conduct and ethics awareness programs -- formerly voluntary -- are now mandatory for most federal contractors. Upon contract award, contractors will be required to furnish their employees with a written code of conduct, establish an Ethics Awareness Program and an Internal Control System, provide ethics training, and ensure their subcontractors have similarly done so. While the government does not spell out the components of an acceptable code and compliance program, penalties for non-compliance include suspension or debarment.

This important briefing explains the changes and the impact of these new rules, and provides a solid outline for establishing compliance plans and internal controls.

About Your Instructors:

Tom Marcinko, Senior Consultant, Aronson & Company

Mr. Marcinko is a Senior Consultant in Aronson & Company’s Government Contracting Consulting Practice. He is responsible for providing clients with a broad variety of both pre and post award support. His areas of expertise include proposal development, contract administration, subcontract administration, FAR compliance, and Government audits. Mr. Marcinko’s experience includes over 27 years of experience in the government contracting arena, including managing contracts for both large and small 8(a) firms. He has extensive experience working with DCAA on pricing and system audits. Mr. Marcinko has presented numerous training classes on a variety of Government contracting subjects. He has also taught several courses in the fundamentals of Government Contracting for the University of Virginia’s Government Contracting Certificate program.

Mr. Marcinko has an undergraduate degree in Accounting from the University of Central Florida, and a law degree from the University of Florida. He is a member of the Florida Bar and the NCMA.

David H. Laufman, Partner, Kelley Drye & Warren LLP

David H. Laufman is a Partner with Kelley Drye’s White Collar Crime and Litigation practices and represents individuals and corporations in all phases of criminal proceedings. He also counsels corporations concerning compliance with applicable regulatory and criminal laws, including the Foreign Corrupt Practices Act, export control and economic sanctions laws, the USA PATRIOT Act, and the Sarbanes-Oxley Act. Drawing on his extensive investigative experience, he conducts internal corporate investigations and represents clients who are the subject of investigations by congressional oversight committees and Offices of Inspector General.

On behalf of government contractors, Mr. Laufman litigates bid protests and counsels corporations on compliance with ethics and internal control regulations and requirements under the FAR and DFAR. In addition to publishing articles on contractor compliance issues, he.

Mr. Laufman joined Kelley Drye in 2007 after serving for more than six years as an Assistant U.S. Attorney for the Eastern District of Virginia, where he specialized in prosecuting terrorism, espionage and other national security cases, and as Chief of Staff to the Deputy Attorney General of the United States. In 2006, he received the Attorney General’s John Marshall Award, the DOJ’s highest award for excellence in litigation, for his work as lead counsel in the government’s successful prosecution of Ahmed Omar Abu Ali, an American citizen who was convicted of providing material support and resources to al-Qaeda, conspiring to assassinate the President of the United States, conspiring to hijack and destroy aircraft, and other charges. As Chief of Staff to the U.S. Deputy Attorney General, he assisted in the management of DOJ operations and helped to coordinate the Department’s response to the September 11, 2001, terrorist attacks.
